Kelvin Zawadiuk, who drove a truck into the Edson provincial building, can appeal restitution, the Alberta Court of Appeal said.
Zawadiuk, 41, rammed a stolen ATCO truck into the building in 2019 and vandalized the indoors with racist graffiti. He was "in a methamphetamine-induced psychosis" at the time, according to Justice Dawn Pentelechuk.
"The circumstances of this application are highly unusual,"
Justice Dawn Pentelechuk wrote for the Court of Appeal. Zawadiuk pleaded guilty to six offences in March 2020 and was sentenced to five years, and to pay restitution of $65,185 to ATCO and $333,879 to the Alberta government.
